General Terms and Conditions (GTC)

1. Scope

These General Terms and Conditions apply exclusively to contracts for the purchase of physical products (prints and original artworks) concluded via the online shop at www.valentina-arros.com.

They do not apply to commissioned work, individual illustration services, or any other services.

2. Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order.

By submitting an order, you make a binding offer to enter into a purchase contract.
The contract is concluded once we confirm your order by email or dispatch the goods.

3. Prices and Payment Terms

All prices stated are final prices and do not include shipping costs.

Any applicable shipping costs are shown separately during the ordering process and are visible before completing the order.

In accordance with §19 of the German Value Added Tax Act (UStG), no VAT is charged (small business regulation).

The available payment methods are displayed during the ordering process.

4. Delivery and Shipping

Delivery is made to the delivery address specified by the customer.

The estimated delivery time is stated in the respective product listing.

5. Transport Damage and Defects

Please inspect the goods immediately upon receipt for completeness and possible damage.

Any obvious transport damage or defects should be reported to us as soon as possible, but no later than seven (7) days after receipt of the goods, by email.

Please include a brief description of the defect and clear photographs of the damaged goods and the packaging.

Statutory warranty rights remain unaffected.

6. Retention of Title

The goods remain our property until full payment has been received.

7. Copyright

The purchase of a print or an original artwork does not transfer any usage or exploitation rights to the buyer.

All copyright and intellectual property rights remain with Valentina Arros.

In particular, it is not permitted to reproduce, distribute, make publicly accessible, or use the artworks for commercial purposes without prior written consent.

This applies regardless of whether the work is a print or an original artwork.

8. Liability

We shall be liable without limitation in cases of intent or gross negligence, as well as for injury to life, body or health.

In cases of slight negligence, we shall only be liable for breaches of essential contractual obligations and limited to the foreseeable damage typical for the contract.

9. Final Provisions

The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

If individual provisions of these General Terms and Conditions are or become invalid, the validity of the remaining provisions shall remain unaffected.

Allgemeine Geschäftsbedingungen (AGB)

1. Geltungsbereich

Diese Allgemeinen Geschäftsbedingungen gelten ausschließlich für Verträge über den Erwerb von physischen Produkten (Prints und Originalkunstwerke), die über den Online-Shop auf www.valentina-arros.com abgeschlossen werden.

Sie gelten nicht für Auftragsarbeiten, individuelle Illustrationsleistungen oder sonstige Dienstleistungen.

2. Vertragsschluss

Die Darstellung der Produkte im Online-Shop stellt kein rechtlich bindendes Angebot dar, sondern eine unverbindliche Aufforderung zur Abgabe einer Bestellung.

Durch das Absenden der Bestellung geben Sie ein verbindliches Angebot zum Abschluss eines Kaufvertrags ab.
Der Vertrag kommt zustande, sobald wir Ihre Bestellung per E-Mail bestätigen oder die Ware versenden.

3. Preise und Zahlungsbedingungen

Alle angegebenen Preise sind Endpreise und enthalten keine Versandkosten.

Die anfallenden Versandkosten werden im Bestellprozess gesondert ausgewiesen und sind vor Abschluss der Bestellung ersichtlich.

Gemäß §19 UStG wird keine Umsatzsteuer berechnet (Kleinunternehmerregelung).

Die verfügbaren Zahlungsmethoden werden im Bestellprozess angezeigt.

4. Lieferung und Versand

Die Lieferung erfolgt an die vom Kunden angegebene Lieferadresse.

Die voraussichtliche Lieferzeit wird im jeweiligen Produktangebot angegeben.

5. Transportschäden und Mängel

Bitte überprüfen Sie die Ware unmittelbar nach Erhalt auf Vollständigkeit und mögliche Schäden.

Offensichtliche Transportschäden oder Mängel sind uns möglichst zeitnah, spätestens jedoch innerhalb von sieben Tagen nach Erhalt der Ware, per E-Mail mitzuteilen.

Bitte fügen Sie der Meldung eine kurze Beschreibung des Mangels sowie aussagekräftige Fotos der beschädigten Ware und der Verpackung bei.

Die gesetzlichen Gewährleistungsrechte bleiben unberührt.

6. Eigentumsvorbehalt

Die Ware bleibt bis zur vollständigen Bezahlung unser Eigentum.

7. Urheberrecht

Mit dem Erwerb eines Prints oder eines Originalkunstwerks werden keine Nutzungs- oder Verwertungsrechte an dem Werk übertragen.

Alle Urheberrechte verbleiben bei Valentina Arros.

Insbesondere ist es nicht gestattet, die Werke ohne vorherige schriftliche Zustimmung zu vervielfältigen, zu verbreiten, öffentlich zugänglich zu machen oder kommerziell zu nutzen.

Dies gilt unabhängig davon, ob es sich um einen Print oder ein Originalkunstwerk handelt.

8. Haftung

Wir haften uneingeschränkt bei Vorsatz und grober Fahrlässigkeit sowie bei Verletzung von Leben, Körper oder Gesundheit.

Bei leichter Fahrlässigkeit haften wir nur bei Verletzung wesentlicher Vertragspflichten und beschränkt auf den vorhersehbaren, vertragstypischen Schaden.

9. Schlussbestimmungen

Es gilt das Recht der Bundesrepublik Deutschland unter Ausschluss des UN-Kaufrechts.

Sollten einzelne Bestimmungen dieser AGB unwirksam sein oder werden, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt.
